This website www.megatronicashop.com (hereinafter, the "Website") is owned by GALEONE SALVATORE (hereinafter, "MEGATRONICASHOP"), with registered office at Via Martiri di Nassirya, 5 - 71041 Carapelle (FG), VAT Number: 03990520714, REA: FG291194, registered at the C.C.I.A.A. of Foggia. Before purchasing any products, the user is required to read these General Terms and Conditions of Sale carefully.
1. Object and Acceptance of the Terms
1.1 If the user is a private consumer (B2C - purchase without a VAT number), the contracts concluded through the Website are governed by Italian Legislative Decree no. 206/2005 (Consumer Code) and Legislative Decree no. 70/2003 on electronic commerce. If the user purchases with a VAT number (B2B), the rules of the Italian Civil Code apply with their respective legal limitations.
1.2 To complete an order, the user must follow the step-by-step procedure on the Website. The contract is considered concluded when the order reaches the MEGATRONICASHOP server. By checking the mandatory box before purchasing, the user declares to fully accept these terms.
1.3 Users are prohibited from creating multiple registrations. In the event of duplicate accounts, MEGATRONICASHOP reserves the right to block access immediately and without prior notice.
1.4 MEGATRONICASHOP reserves the right to refuse or cancel orders from users with whom a legal dispute is pending, who have previously violated these Conditions, who are suspected of fraud, or upon notification of anomalies by payment networks (PayPal, banks, etc.).
2. Product Availability and Pricing Errors
2.1 Products are offered within the limits of their real-time availability. If multiple users purchase the same item simultaneously, or if a product fails our strict internal Quality Control on packaging prior to dispatch and no other stock is available, the client will be contacted promptly.
2.2 In case of subsequent unavailability, the customer may: (I) wait for restocking, (II) choose an alternative product of equivalent or higher value (paying the difference), or (III) terminate the contract with a full refund of the amount paid within 14 days.
2.3 Macroscopic Pricing Error: In the event that a product is published on the Website at a clearly incorrect price (ridiculous or disproportionately low compared to the market value due to technical bugs), MEGATRONICASHOP reserves the right to cancel the order, fully refund the user, and halt the shipment.
3. Payment Methods
The user can choose from the following payment methods directly at checkout:
- Credit or Debit Card (Visa, Mastercard): Immediate and free charge.
- PayPal: Secure transaction on PayPal's encrypted servers. In case of online installment financing via linked credit agreements, the contract is finalized upon ultimate approval by the financing company.
- Advance Bank Transfer: The order remains suspended until cleared funds are received. The customer must send the transfer receipt via email to info@megatronicashop.com within 3 business days of the order; the actual funds must clear within 7 calendar days, otherwise the order will be automatically canceled. It is mandatory to include the Order Number in the payment reference.
- seQura (Tailor-made Flexibility): Allows options such as "Pay Later" (after delivery), "Pay in 3" with Zero Interest (0% APR), or "Pay in Installments" up to 12 months. Approval is immediate in real-time by entering only the Tax ID (Codice Fiscale).
- Klarna: This service is currently temporarily suspended on our store.
- Carta del Docente (Italian Teacher's Voucher): Accepted for eligible computer products (Hardware/Software). The process is manual: the user must complete the order on the site and send the ministerial voucher ID code along with the order number to info@megatronicashop.com. Vouchers are validated during office hours (09:30 - 19:00 CET). MEGATRONICASHOP declines all responsibility for vouchers expiring outside of these hours.
4. Shipping, Delivery and Recipient Obligations
4.1 MEGATRONICASHOP ships within the Italian territory (excluding Livigno and Campione d'Italia). Shipments to Europe are evaluated only in exceptional cases.
4.2 Courier Selection: The client can choose between DHL and GLS at checkout. However, shipments with a total weight **exceeding 1 kg** will be assigned exclusively to GLS, regardless of the user's selection.
4.3 Processing and packaging take 3-5 business days, followed by 24/48 business hours of courier transit. All standard shipments are insured under standard legal carrier coverage.
4.4 Optional Paid Services: The user can add Extra Packaging (supplementary protection) or Fast Insured Shipping (External Partner) at checkout. The latter guarantees a refund or replacement of the product within just 7 days in case of theft, loss, or damage (instead of waiting for the standard courier claim times of up to 45 days).
4.5 Remote Areas and Minor Islands: Shipments bound for remote destinations (e.g., Venice lagoon, minor islands) require a mandatory surcharge of € 24.50, to be settled post-checkout via a PayPal or card integration request.
4.6 Checking Goods and Specific Reserve: Upon delivery, the risk transfers to the customer. If the packaging is damaged, crushed, or wet, the customer must write a detailed and Specific Reserve of Control on the carrier's delivery note (e.g., "Accepted with reserve as the box is crushed on the right side") or refuse the parcel. In the absence of a written specific reserve, the insurance will not cover internal transit damage. Hidden damage must be reported within 8 days of receipt.
4.7 Deliveries cannot be made to Post Offices or PO Boxes.
5. Obligation to Collect and Storage Fees
5.1 Collecting the product is a contractual obligation. If the recipient is absent, the courier leaves a notice. The customer must collect the package from storage within 2 calendar days.
5.2 If the item is not collected within the deadline, the contract will be automatically terminated ex art. 1456 of the Italian Civil Code. MEGATRONICASHOP will refund the amount paid, fully deducting the outward shipping fees, storage fees, and goods return costs.
5.3 Users who fail to collect their parcels more than twice on different orders will no longer be authorized to make purchases on the Website.
6. Right of Withdrawal (Returns Policy)
6.1 Private consumers (B2C) have the right to withdraw within 14 calendar days of delivery without giving a reason, by sending a notice to info@megatronicashop.com or using the official PDF form.
6.2 Integrity Conditions: The product must be returned intact, complete with all accessories, and in its original box (which must not be registered, initialized, or personalized). It is forbidden to apply labels or tape directly onto the product box; the latter must be placed inside an additional protective external shipping box. All return shipping costs and risks are borne entirely by the customer.
6.3 Absolute Rejection of Returns: Returns or withdrawals are ALWAYS REFUSED in the event of:
- Apple products or other brands where the **hardware warranty has been activated or the operating system initialized** by the client.
- Sealed goods opened after delivery that are unsuitable for return due to hygienic reasons (e.g., electric shavers, toothbrushes).
- Purchases made by companies or professionals with a VAT number (B2B).
- Reports of malfunctions after the 14-day window (in this case, only the Legal Warranty applies at official manufacturer support centers).
7. Legal Warranty of Conformity
7.1 The Legal Warranty covers conformity defects existing at the time of delivery that manifest within 24 months for private consumers (B2C) and 12 months for business clients (B2B). The legal action expires in 26 months.
7.2 Once the first 14 days from delivery have passed, for any hardware defect, the user **must contact the manufacturer's official authorized Technical Assistance Centers (TAC)** to claim free repairs under warranty. If handled through MEGATRONICASHOP, logistic times will be longer due to double shipping steps.
7.3 Damage caused by accidental drops, liquids, software tampering, or natural battery wear is excluded from the warranty.
8. Applicable Law, Jurisdiction and ODR/ADR
8.1 These Conditions are governed by Italian law. For B2C disputes, the mandatory territorial jurisdiction belongs to the Judge of the place of residence or domicile of the consumer (if located in Italy). For B2B clients, exclusive jurisdiction belongs to the Court of Foggia.
